The Seventh Circuit has held that service by email on a Chinese defendant is only proper if the Hague Convention does not apply because the defendant's physical address remains unknown, even after reasonably diligent efforts to ascertain it. Kangol LLC v. Hangzhou Chuanyue Silk Import & Export Co., 2026 WL 1502198, at *6 (7th Cir. May 29, 2026). In Trevor Talhami's Declaration 45, Plaintiff indicates the following: (1) Plaintiff requested addresses of each Defendant from third-party online marketplace platforms; (2) there was no physical address provided for Defendant No. 8; and (3) regarding the other Defendants, Plaintiff searched for the addresses on Google Maps and Baidu but the "searches either did not locate this address or did not include any results for this specific address showing that it is affiliated with Defendant." 45. Where no address was provided, the address is unknown. Where the search result did not provide an identifiable physical location, the Court finds that the address remains unknown after reasonably diligent efforts to ascertain it. But where the search results provided an identifiable physical location (for example: returning a match or partial match for the address that an investigator could physically go to, even if the address does not appear to be affiliated with the Defendant), the Court finds that reasonably diligent efforts to find a defendant's address require Plaintiff to take additional investigative steps, such as sending an investigator to that location. See Su v. HHUNSHA, No. 26-cv-4878 (N.D. Ill.) at Docket No. 25. Plaintiff's motion 43 for entry of default is denied without prejudice. Presentment of motion set for 7/1/26 is stricken. The plaintiff's written submissions establish that if defendants were informed of this proceeding before a TRO could issue, assets would likely be redirected, defeating plaintiff's interests in identifying defendants, stopping the infringement, and obtaining an accounting. In addition, the submitted evidence establishes a likelihood of success on the merits, the harm to plaintiff is irreparable and an injunction is in the public interest because infringement interferes with the plaintiff's ability to control its intellectual property. Those rights cannot be fully compensated by money damages. There is no countervailing harm to defendants from an order directing them to stop infringement. Electronic service of process does not violate any treaty and is consistent with due process because it is an effective, perhaps the most effective, way to communicate with defendants. Expedited discovery is warranted to identify defendants and implement the asset freeze. If any defendant were to appear and object, the court will take a fresh look at the asset freeze, joinder, and personal jurisdiction. The court finds that security in the amount of $10,000--$1,000 per defendantis sufficient to secure the injunctive relief. Motion hearing set for 5/5/26 is stricken.Notice mailed by Judge's staff
