Defendant 1 is in fact a party to this action, and therefore may appear at such hearing by counsel as a matter of course and nothing in the Order at [46] is contrary to that. Given that it appears that no relief is being sought at that hearing as to Defendant 1, the Court is uncertain as to what matters Defendant 1 would have a recognized interest in addressing at such hearing, but we will all see at that time. Defendant 1 will be permitted to attend and participate, but will not be provided two bites at the apple, e.g. having successfully objected to being included in the scope of the Order at [46], and having now filed a Motion to Dismiss the action as to itself [60], Defendant 1 will not be permitted to piggyback an argument on the merits of its own case onto a hearing that does not involve its interests, especially in light of its own pending Motion to Dismiss, which will not be ripe as of August 26, 2026, the date of said hearing.
