| 21 | 2026-08-07 | MINUTE entry before the Honorable Charles P. Kocoras: Plaintiff's ex parte motion for a temporary restraining order ("TRO") 8 is granted. Plaintiff's motion for expedited discovery and electronic service of process 9 is granted in part and denied in part. For the reasons set forth in the motion 8, Plaintiff's request for expedited discovery is granted. As to electronic service of process, the motion is denied without prejudice. The exhibits submitted in support of the request show, as to each Defendant, completed purchases of the allegedly infringing products delivered to customers in Illinois. Where a plaintiff's investigation yields an identifiable physical location, reasonable diligence requires the plaintiff to pursue that lead through additional investigative steps-such as test mailings to the address by an established courier, follow-up with the courier regarding any failed deliveries, or an in-person visit by an investigator-before deeming the address unknown. See Su v. HHUNSHA, No. 26 C 4878, Dkt. 25 (N.D. Ill. June 22, 2026) (Alonso,); accord Nos. 26 C 6033 (N.D. Ill. June 15, 2026) (Alexakis) & 26 C 6096 (N.D. Ill. June 17, 2026) (Jenkins) (minute entries) (finding reasonable diligence where counsel's sworn declaration detailed Baidu searches, a Qichacha search under the defendant's actual business name, multiple test mailings by an established courier, and personal follow-up with the courier). Database searches alone, without exhaustion of the addresses actually in Plaintiff's possession, are not a substitute for reasonable diligence. See Deckers Outdoor Corp. v. A AO, 2026 WL 1802901 (N.D. Ill. 2026); NBA Props., Inc. v. HANWJH, 549 F. Supp. 3d 790, 796 (N.D. Ill. 2021). Plaintiff may file a renewed motion for electronic service of process supported by sworn declarations detailing the specific, diligent efforts taken as to each Defendant-and the outcome of those efforts. Plaintiff is directed to submit an updated proposed order, in Microsoft Word format, regarding the TRO and expedited discovery to the Court's proposed order inbox by 8/10/2026. A status report is due on 9/8/2026. Mailed notice |
