| 4 | 2026-07-30 | Ex Parte MOTION for Preliminary Injunction and Limited Expedited Discovery by The Ansel Adams Publishing Rights Trust. |
| 5 | 2026-07-31 | Minute Order by Judge Jinsook Ohta: On July 30, 2026, Plaintiffs Best's Studio, Inc. and The Ansel Adams Publishing Rights Trust filed an ex parte application for a temporary restraining order ("TRO") and preliminary injunction enjoining Defendants Brittany Moorefield and BMBW Art LLC from using a disputed domain and email and destroying evidence. Dkt. 4 ("TRO Mot."). The Court finds that Plaintiffs are not entitled to TRO relief because they have not made a clear showing that they will be irreparably harmed unless the Court grants their requested relief. Under Fed. R. Civ. P. 65(b), a TRO is an "extraordinary remedy" that a Court should grant only upon a "clear showing" that the Plaintiff is entitled to their requested relief. Winter v. Nat. Res. Defense Council, Inc., 555 U.S. 7, 22 (2008). To obtain a TRO, a plaintiff must establish that (1) they are likely to succeed on the merits; (2) they are likely to suffer irreparable harm in the absence of preliminary relief; (3) the balance of equities tips in their favor; and (4) an injunction is in the public interest. Am. Trucking Ass'ns Inc. v. City of Los Angeles, 559 F.3d 1046, 1052 (9th Cir. 2009) (quoting Winter, 555 U.S. at 21); see also Stuhlbarg Int'l Sales Co., Inc. v. John D. Brush & Co., Inc., 240 F.3d 832, 839 n.7 (9th Cir. 2001) (stating the standard for a TRO and preliminary injunction is "substantially identical"). Here, Plaintiffs fail to offer evidence sufficient to establish a likelihood of irreparable harm. See Herb Reed Enters., LLC v. Fla. Ent. Mgmt., Inc., 736 F.3d 1239, 1250 (9th Cir. 2013) (harm must be grounded in evidence, not "unsupported and conclusory statements"). Plaintiffs appear to allege that Defendants might alter, delete, or reimage devices and data absent a court-enforced preservation protocol. See TRO Mot. at 2021. But as Plaintiffs concede, Defendants have repeatedly represented in writing that they are preserving potentially relevant materials, are not using the disputed domain or email, and will not alter device or domain settings except to prevent data loss. See id. at 20. Because the opposing party has represented that it will not engage in the very conduct the movant fears, and there is no evidence of an actual or imminent breach of that commitment, Plaintiffs fail to carry their evidentiary burden on irreparable harm. See Herb Reed, 736 F.3d at 1250. Accordingly, the Court DENIES Plaintiffs' ex parte application for TRO without prejudice to filing a motion for preliminary injunction after proper service of the complaint and summons. Counsel for Plaintiffs are also ordered to not use generative AI tools in the drafting of their briefs and warned that the Court will issue an order to show cause regarding sanctions if it has reason to suspect a violation of this order in future submissions. Signed by Judge Jinsook Ohta on 07/31/2026. |
