2026-08-21 | NOTICE of Motion by Martin Francis Trainor for presentment of motion for miscellaneous relief[17], motion for miscellaneous relief[13], motion for miscellaneous relief[3] before Honorable Manish S. Shah on 8/26/2026 at 09:45 AM.
2026-08-24 | MINUTE entry before the Honorable Manish S. Shah: Plaintiff's ex parte motions [3] [13] [17] are denied, and no appearance is necessary. The court does not agree that plaintiff's general and boilerplate fears of document destruction and movement of assets justifies sealing presumptively public court files, even on a short-term basis. Moving money is not a fraudulent transfer and an ex parte asset restraint, which ultimately is only intended to collect statutory damages, is not appropriate. While plaintiff has a likelihood of success in proving infringement, the court is uncertain that each defendant is properly joined (where some defendants are infringing different works and using different means to infringe, e.g., figurines as compared to t-shirts). Plaintiff's sealed filings are also too voluminous for prompt judicial review and sealed filings impose a burden on the court that is not warranted. In sum, a Schedule A case of this type, with this many defendants, is too unwieldy and the relief requested in the ex parte TRO is overbroad. This court declines to hear it as an ex parte, sealed, non-adversarial matter. The clerk shall unseal all filings. Plaintiff is free to file a standalone motion for early discovery and pursue service of process within the 90-day deadline set by Rule 4. The number of defendants is not good cause for an extension of time for service on any one defendant, even if the number of defendants causes a delay in the court's review of plaintiff's diligence in determining the address of a defendant. Plaintiff chose to make service of process more difficult by naming so many defendants, and offers no explanation for why plaintiff could not have named fewer defendants. Based on the related cases disclosed in the civil cover sheet, plaintiff could name fewer defendants. If plaintiff cannot serve defendants within 90 days because of plaintiff's choice, dismissal without prejudice for lack of service is the appropriate result. Notices mailed.
2026-09-02 | MOTION by Plaintiff Capcom Co., Ltd. for Expedited Discovery
2026-09-02 | NOTICE of Motion by Martin Francis Trainor for presentment of motion for miscellaneous relief[20] before Honorable Manish S. Shah on 9/9/2026 at 09:45 AM.
2026-09-04 | MINUTE entry before the Honorable Manish S. Shah: The motion for expedited discovery [20] is granted in part, and no appearance is necessary. Plaintiff has good cause to conduct expedited discovery to identify defendants and their addresses for service of process. No good cause exists to discover sales information or financial information at this early, pre-service stage of the litigation. Enter Order. Plaintiff shall file a status report by 11/4/26 explaining its plan to serve defendants and showing cause why the court should entertain a case with this many defendants selling disparate products that are unlikely to be involved in the same transaction or series of transactions. Notices Mailed.
