| 16 | 2026-07-16 | ORDER DIRECTING PARTIES TO FILE ALL DOCUMENTS ON THE COURT'S DOCKET. The Court hereby notifies all parties to the pending civil action that all statements of position, pleadings, motions, or requests for court action must be filed as such on the official Court docket. Electronic or other messages to the Judge or Chambers will not be considered by the Court. The Court directs the parties to the following website in order to register to become an electronic filer: https://pacer.psc.uscourts.gov/pscof/regWizard.jsf. Counsel for the Plaintiff shall transmit a copy of this Order to all Defendants by electronic means, forthwith. Signed by Judge Mark R. Hornak on 7/16/26. Text-only entry; no PDF document will issue. This text-only entry constitutes the Order of the Court or Notice on the matter. |
| 17 | 2026-07-23 | ORDER DIRECTING REFILING OF PAPERS BY PLAINTIFF, AND STAYING AND ADMINISTRATIVELY CLOSING THE ACTION ON THE DOCKET. The Plaintiff filed seven (7) exhibits (ECF Nos. 7-8, 7-9, 7-10, 7-11, 7-12, 7-13, 7-14) containing images that purport to depict Defendants products. The exhibits are not organized by Defendant number and contain extensive amounts of extraneous material. They also do not include side-by-side comparisons of the product(s) Plaintiff is alleging Defendants' products infringe upon. The Court has gone over this ground with Plaintiff and its counsel before in fact, it had to issue this exact same Order in the first case filed by this Plaintiff in Civil Action No. 25-1957, ECF No. 18. In that Order, the Court stated the following: "The Plaintiff has proffered what appear to be exemplars of alleged infringing products, with the depictions of such products buried (in the court's estimation) in advertisements/on-line postings/depictions of numerous products of each Defendant. None of the exemplars are organized or arranged by Defendant number corresponding to the Schedule A listing advanced by the Plaintiff, nor do they appear to be presented in any readily-apparent organized fashion, as opposed to what is essentially a blob of photographs of such allegedly infringing products. Plaintiff needs a 'do over.'" The Court should not have to repeat itself with the same Plaintiff and the same Plaintiff's counsel, and yet it is compelled to do so now. Plaintiff needs a do over; the Court will take no further action at this time. The case will be STAYED and administratively closed until such time as Plaintiff cleans this up, has the papers central to the interim relief it seeks in shape, and filed a Notice on the docket that the action is prepared to proceed in an orderly fashion. Signed by Judge Mark R. Hornak on 7/23/26. Text-only entry; no PDF document will issue. This text-only entry constitutes the Order of the Court or Notice on the matter. |
