| 10 | 2026-09-30 | MINUTE entry before the Honorable John J. Tharp, Jr: The Civil Cover Sheet in this case [3] erroneously states that this case is not a refiling of a previously dismissed action. Although the Civil Cover Sheet reflects a "related" case before Judge Hunt, 26-cv-8364, Plaintiff's status report [7] further states that "the single Defendant in this case was named previously in that case," an infringement action over the same copyright. There is no distinction between the two cases except that there is only one defendant here. Judge Hunt dismissed case no. 26-cv-8364 on 8/19/2026, and the Plaintiff filed the instant case on 9/21/2026. This case should be reassigned to the calendar of Judge Hunt pursuant to Local Rule 40.3(b)(2) ("When a case is dismissed with prejudice or without, and a second case is filed involving the same parties and relating to the same subject matter, the second case shall be assigned to the judge to whom the first case was assigned. The designation sheet presented at the time the second case is filed shall indicate the number of the earlier case and the name of the judge to whom it was assigned." See Local Rule 40.3.) The Court requests that the Executive Committee approve the reassignment. The Clerk is directed to forward a copy of this order to the Executive Committee and to Judge Hunt. Mailed notice |
| 11 | 2026-09-30 | MINUTE entry before the Executive Committee: Case reassigned to the Honorable LaShonda A. Hunt for all further proceedings pursuant to Local Rule 40.3(b)(2). Mailed notice. |
| 12 | 2026-10-09 | MINUTE entry before the Honorable LaShonda A. Hunt: This case has been reassigned to Judge LaShonda A. Hunt pursuant to Local Rule 40.3(b)(2). Judge Tharp ordered this case reassigned because Case No. 26-cv-08364, involving the same Plaintiff, Defendant, and set of operative facts, was previously before this Court. All attorneys and self-represented ("pro se") parties are required to review the case procedures posted on the Court's webpage, including the requirement to set motions for in-person presentment on at least three business days' notice and propose an agreed briefing schedule for opposed motions. Filings that do not comply with the Local Rules or Judge Hunt's case procedures may be summarily stricken. For the reasons described in the accompanying written order, the previous order [6] on Plaintiff's motion to leave to file under seal [5] is vacated and Plaintiff's motions to file under seal [5] [11] are denied. The Clerk of Court is directed to unseal the documents filed at [2] [10]. The Clerk's office is also directed to update the caption to reflect that the Defendant in this case is "USTCOT". Second, Plaintiff's motion for leave to file excess pages [12] is granted, but its ex parte motion for a TRO and other relief [8] is denied without prejudice. By 10/21/26, Plaintiff is ordered to file a status report proposing next steps in this case, if no other appropriate relief has been sought by that date. Considering the history of this case, failure to comply with this order will result in the case being dismissed with prejudice for want of prosecution and non-compliance with court orders.
