In the post-Kangol world it would appear that the propriety of electronic/e-mail service under the Hague Convention will have to be litigated on a defendant-by-defendant basis; alternatively, if plaintiff chooses to go the personal service route, it is likely that the matter will be pending for a very extended period while awaiting overseas service. Either way, this impacts the Court's view regarding the practical limits of proper joinder. Plaintiff is ordered to show cause in writing by 6/22/2026 why the complaint in its current form should not be dismissed for improper joinder. An in-person hearing on the show cause order and plaintiff's pending motion for a TRO is set for 6/26/2026 at 9:15 AM in Courtroom 2103. No telephonic or other remote appearances will be allowed. |
