212026-04-29ORDER MAILED copyright report with certified copy of closing order dated 4/28/26 to Registrar, Washington DC (bi,)
202026-04-28MINUTES MINUTE entry before the Honorable John Robert Blakey: Pursuant to the Notice of Voluntary Dismissal, 19, this case is dismissed without prejudice under Rule 41(a). The Court strikes all set dates and deadlines. Civil case terminated. Mailed notice.
192026-04-27DISMISSAL NOTICE of Voluntary Dismissal by Wayne Pascall as to the Defendant(s) Identified on Amended Schedule A 14
182026-04-10MINUTES MINUTE entry before the Honorable John Robert Blakey: Plaintiff shall file a status report by 4/27/26 proposing next steps to advance this case. Mailed notice.
172026-03-13MINUTES MINUTE entry before the Honorable John Robert Blakey: Based upon Plaintiff's representations that it has never named any of the 84 defendants identified in this case in a prior case asserting infringement of the same intellectual property 16, Plaintiff may proceed on its amended complaint 13. Mailed notice.
162026-03-11RESPONSE RESPONSE by Plaintiff Wayne Pascall to terminate deadlines and hearings, 15
152026-02-26MINUTES MINUTE entry before the Honorable John Robert Blakey: Plaintiff has filed an amended complaint and an amended Schedule A, naming just one Defendant, see 13, 14, which avoids any joinder issues. But before Plaintiff may proceed, it must file a supplemental report confirming whether it has previously named any of the 84 defendants identified in this case in a prior case asserting infringement of the same intellectual property. See Julie Stiebritz v. The Partnerships and Unincorporated Associations Identified on Schedule A, No. 1:25-cv-03459, at 19 (N.D. Ill. Apr. 9, 2025) (dismissing the case because plaintiff previously named defendants in a prior case and dismissed them to avoid an unfavorable joinder ruling, which constitutes forum shopping). Plaintiff shall file the report by 3/11/26. Mailed notice.
142026-02-20SCHEDULES Amended Schedule A 2 to Amended Complaint by Wayne Pascall
132026-02-20COMPLAINT AMENDED complaint by Wayne Pascall against Super HD poster 1 attachment — 02/20/2026 NEW PARTIES: Super HD poster added to case caption. Terminating The Partnerships and Unincorporated Associations Identified on Schedule A (Text entry; no document attached.)
122026-02-04MINUTES MINUTE entry before the Honorable John Robert Blakey: Plaintiff seeks to sue 84 separate defendants in this single copyright infringement action, see 1, 2. Joinder of multiple defendants in a single copyright infringement action remains appropriate only if the claims against the defendants are asserted "with respect to or arising out of the same transaction, occurrence, or series of transactions or occurrences," and a common question of law or fact exists as to all defendants. Fed. R. Civ. P. 20(a)(2)(A)-(B). In this regard, Plaintiff alleges that the "Defendant Internet Stores share unique identifiers, such as design elements and similarities of the unauthorized products offered for sale, establishing a logical relationship between them and suggesting that Defendants' illegal operations arise out of the same transaction, occurrence, or series of transactions or occurrences. Defendants' activities, occurring at the same time and in the same retail space and manner as one another, blend together to create a single negative impression on consumers such that they constitute the same occurrence or series of occurrences." 1 7. This allegation includes legal conclusions, which this Court need not accept. Additionally, the one does not necessarily follow the other; it is equally possible that each online retailer set up shop in the same or similar manner. See, e.g., Estee Lauder Cosms. Ltd. v. Partnerships & Unincorporated Associations Identified on Schedule A, 334 F.R.D. 182, 188-89 (N.D. Ill. 2020). The Court thus dismisses the complaint 1 for improper joinder. To the extent Plaintiff can, consistent with its obligations under Rule 11, amend its complaint to allege facts to support the joinder of 84 defendants in this single action, it may do so by 2/23/26; if Plaintiff does not amend, the Court will dismiss this case. Mailed notice. — 01/16/2026 ADMIN CLERK'S NOTICE: Pursuant to Local Rule 73.1(b), a United States Magistrate Judge of this court is available to conduct all proceedings in this civil action. If all parties consent to have the currently assigned United States Magistrate Judge conduct all proceedings in this case, including trial, the entry of final judgment, and all post-trial proceedings, all parties must sign their names on the attached Consent To form. This consent form is eligible for filing only if executed by all parties.
